Update #2: Driver Involved In March 4th Fatal Traffic Crash Arrested - Highway 99 north of Eugene

An ongoing investigation by Oregon State Police troopers, working in conjunction with the Lane County District Attorney's Office, resulted in the arrest this weekend of the driver of the offending vehicle. EDUARDO GUTIERREZ, age 41, from Eugene, was taken into custody and lodged in Lane County Jail on the following charges:
 
* Manslaughter in the Second Degree
* Assault in the Third Degree
* DUII
* Reckless Driving
 
Investigators initially identified RODRIGUEZ EBIGAEL SANCHEZ, age 29, from Eugene, as the driver but follow-up investigation and interviews with both men and emergency responders led to GUTIERREZ being identified as the driver.
 
According to Oregon State Police Sergeant Ron Martin, investigators report that on March 4, 2008 at 6:43 p.m. a 1988 Dodge pickup driven by GUTIERREZ was northbound on Highway 99 near Aubrey Lane. According to witnesses the Dodge pickup failed to negotiate a right hand curve, continued through the center divider and into the southbound lanes where it crashed head-on with a 1988 Honda two door car.
 
The Honda's operator, JUSTIN DANIEL DOUGHERTY, age 23, from Eugene, was transported to Sacred Heart Hospital where he was pronounced deceased. DOUGHERTY was using safety restraints.
 
SANCHEZ and GUTIERREZ were transported to Sacred Heart Hospital with serious injuries. GUTIERREZ reportedly has a valid drivers license and was arrested following his release from the hospital.
 
Oregon State Police troopers from the Springfield Area Command are continuing the investigation. Alcohol is a contributing factor.
 
Highway 99 was partially closed for approximately 4 1/2 hours. ODOT, Lane County Sheriff's Office, Lane Rural Fire, and Eugene EMS assisted at the scene.
