Returning to Work Info for PERS/OPSRP Members
I was a Tier One or Tier Two member (Tier One members were hired into a PERS-qualifying position before January 1, 1996; Tier Two members were hired into a PERS-qualifying position on or after January 1, 1996.)
I was an Oregon Public Service Retirement Plan (OPSRP) member (Hired into a PERS-qualifying position on or after August 29, 2003.)
US census information is used to determine PERS employer eligibility for exemptions to the Chapter 238 Program (Tier One/Tier Two) retiree 1,040-hour/calendar-year work limit. Employers should use year 2000 census population information to determine positions exempt from the 1,040-hour limit, not estimated population size through December 31, 2011. Updated census data will be posted on the PERS website when available in 2011 for use beginning January 1, 2012.
OAR 459-017-0060 establishes as the operative date for federal census data the first day of the second calendar year following the census year. For the 2010 census, the operative date will be January 1, 2012. This accommodates the mid-year release of data in 2011, avoiding retroactive application to the census date in 2010 and shifting standards during calendar year 2011. Employers and retired members can then make informed decisions about employment for calendar year 2012.
