The Commission has scheduled a workshop for September 8. Comments are due by September 22, and a hearing is scheduled for September 29.
Please be aware that the proposed rule was drafted prior to passage of SB 622. As a result, it does not contain the time frames required by the Act. [Section 38, subsections (2) through (6)]. Nor does it contain references to the "prohibited acts" included in the Act. [Section 38, subsections (1)(a) through (1)(j)]. In the event SB 622 is signed by the Governor, the rule will be modified to address the unique procedural issues involved in complaints based upon violations of prohibited practices under SB 622. Input will be solicited on how the proposed rule can best be modified to conform to the requirements of SB 622.
