Circuit Court Filing Fee Changes Effective October 1, 2009

Legislative changes in 2009 that become effective October 1, 2009, will significantly change some court filing fee amounts.  (HB 2287, ch. 659, Oregon Laws 2009).

Before filing papers in a state court on or after October 1, 2009, please check the court's website or contact the court for correct fee amounts.

For circuit courts, there is no single circuit court fee schedule.  Circuit court fees vary by county, depending on local fee assessments. Please check the website for the court where you plan to file. If the court has not posted its fee schedule on its webpage, then contact the court directly for information. Information on Certain Fees

Here is specific information regarding the new civil filing, additional party, ex parte order, and judgment fees. These fees go into effect on October 1, 2009.  Click on the links below to view the following documents:

Please note that the fees discussed in the memorandum are the BASE FEES established by 2009 HB 2287.  YOUR TOTAL FILING FEE WILL BE HIGHER.  The fees shown in the table and the fee calculator include additions to the fees (for Legal Aid, law library, etc.) as required by statute and reflect the total fee due.  We would also like to point out that the amount of the ex parte order fee and the judgment fee is $10. 

We hope that the table and auto calculating worksheet will be of particular value to attorneys and their staff.  We have also shared this worksheet with the courts for use by their staff.  The worksheet is in Microsoft Office Excel 2007, and it should simplify the task of determining the fee owed on a given pleading.  Instructions are included in the memorandum to the couts.
