Item 1 Approve Agenda

Item 2 Public Comment

This part of the agenda is for comments on topics not scheduled elsewhere on the agenda. The chair may set time limits (usually three minutes) for individual speakers. The maximum time for all public comments under this agenda item will be limited to 30 minutes. If you bring written summaries or other materials to the meeting please provide the commission assistant with 20 copies prior to your testimony. The commission is unable to take action, at this meeting, on items brought to their attention in this forum.

Item 3 City of Corvallis

The commission will consider a proposed order and recommendation from its appointed hearings officer regarding a petition for enforcement under ORS 197.319 to 197.335. The petition for enforcement was made under ORS 197.320(10), which directs the commission to require a local government to take action to bring its comprehensive plan, land use regulations, or other land use decisions into compliance with the state land use goals if the local government’s approval standards, special conditions on approval of specific development proposals, or procedures for approval do not comply with statutory requirements for needed housing under ORS 197.307(4) or (6). In its review of the proposed order, the commission shall not consider new evidence, but will consider oral arguments and exceptions made by the parties to the contested case.

Item 4 Sage Grouse Registry
The department will make a recommendation to the commission to initiate rulemaking in order to modify the existing human disturbance baseline values for sage grouse core areas (OAR 660-023-0115, Exhibit D). The original baseline values were determined using a variety of datasets that were the best available in 2013-2014. One of these datasets delineating electric transmission lines was a proprietary dataset that is now preventing the department from creating a fully transparent central registry as directed in Section 15 of OAR 660-023-115 (a.k.a. Sage Grouse Rule). This rulemaking is intended to modify the baseline values to reflect the use of a replacement transmission line dataset that is state-owned and maintained. No other amendments to the Sage Grouse Rule, the baseline values, or the supporting datasets will be requested. 

Item 5 Director’s Report
The commission will receive an update by the director on recent matters concerning the department. 

Item 6 Commission Business
The commission will receive a Budget and Management subcommittee report and other commission business. The commission will present the STAR Award to the Port of Portland.

Item 7 Request to Appeal
State law requires commission approval of a DLCD director’s decision to seek review of a local government land use decision. Only the director or department staff on the director’s behalf, the applicant, and the affected local government may submit written or oral testimony concerning commission approval of a director’s recommendation to file or pursue an appeal, or intervention in an appeal, of a land use decision, expedited land division, or limited land use decision. This item is scheduled as a placeholder as the department does not anticipate making such a request.
