TEACHER STANDARDS AND PRACTICES COMMISSION
April 15, 2017
 
On April 6, 2017, the Teacher Standards and Practices Commission voted to refer the following proposed rule changes for public comment.  The proposed rules will be open for public comment from April 15, 2017 to June 1, 2017.  Public comment on the proposed rulemaking will be accepted until 5.00 p.m. on June 1, 2017.
 
The agency has scheduled a public hearing on the proposed rules for May 31, 2017 at 4 pm at the TSPC Salem Office: 250 Division St. NE Salem, OR 97301.

Comments on the proposed rules should be emailed to
during the public comment period.
 
The proposed rule changes will be considered for permanent rulemaking at the Commission’s meeting on June 19-21, 2017 in Newport, Oregon.

Change the reporting date from September 30 to April 15.  This change will align with the CAEP annual report timeline and will allow the EPPs more time to analyze the previous year’s data.
 
The reporting year will remain September 1 to August 31.
 
The specific reporting requirements will be outlined in the TSPC Program Review and Standards Handbook.

Teacher Candidate Performance Assessments
Changes the timing of edTPA requirement as follows:
·         Moves the consequential date of the edTPA from September 1, 2017 to September 1, 2018.
·         Moves the date for establishing a passing score level for edTPA from prior to September 1, 2017 to January 1, 2018.
·         100 percent of candidates will still be required to complete the edTPA.
Makes other changes:
·         Clarifies the process for preservice candidates wanting to qualify for two endorsements with first licensure:  No performance assessment is required for second endorsement.  Reminder: The program must have an approved program for both endorsements.
·         Clarifies that licensed teachers adding endorsements to existing licenses are not required to complete a teacher performance assessment.

Adopts a rule related to cooperating teacher qualifications and training requirements:

Definitions
Prohibits educator to engage in sexual conduct with a person previously known to the educator as a student, or who has left school or graduated in the 90 days prior to the conduct.
 
Defines student as “any individual enrolled in the state's public or private schools from preschool through high school graduation or any individual between under the age of 18.”

Grounds for Disciplinary Action
Eliminates specific list of crimes and simply references the statute, ORS 342.143.  This change will eliminate the need to amend the rule every time the statutory crimes are changed.
 
Adds marijuana to list of substances that are prohibited from appearing on duty or at any district-sponsored activity while under the influence.

Termination of Probation
 Amends rule to eliminate the requirement for a notarized affidavit – applicants must simply submit materials sufficient to indicate they have met all terms of probation.
 
If no terms are established and no further violation of Commission rules has occurred, the probation would simply expire.

One year license, renewed up to two times – for a total of three years.
 
Requires:

 ·         At least an AA degree or meet requirement for waiver;

·         Not completed teacher prep program;

·         Civil Rights and Ethics Exam;

·         Background Clearance

·         IAC recommendation;

·         CTE Professional Development Plan;

·        Evidence sponsoring District has approved CTE program.

·        Evidence of Work Experience in the Requested Endorsement Area.

Must complete a CTE Professional Development Plan within three years to move to Preliminary CTE Teaching License.

CTE Instructor Appraisal Committees
An Instructor Appraisal Committee (IAC) is a committee of industry and education experts that evaluate applications for CTE licensure and endorsements based on work experience and preparation in a CTE endorsement area. The IAC is appointed by the ODE Regional Coordinator.

A CTE Professional Development Plan is required component of the ODE CTE application for the Restricted CTE Teaching License or a License for Conditional Assignment for CTE endorsement.
 
The PDP must be completed prior to qualifying for the Preliminary CTE Teaching License.

CTE Work Experience
Candidates for CTE endorsements must complete at least 2000 hours of relevant and documented work experience in the requested CTE endorsement area.
 
Alternatives to work experience requirement are:
·         Related industry certification or licensure;
·         Related technical courses; or
·         Planned and Coordinator Work Experience;
·         EPP certified work experience for their pre-service candidates for Preliminary Teaching License’
·         ODE waiver.
