The 2015 Oregon Legislature passed SB 705 concerning asbestos surveys of residential properties. This bill directs the Environmental Quality Commission to adopt rules requiring that an inspector conduct an asbestos survey of a residence before that property is demolished. EQC will adopt rules requiring an asbestos survey, specifying survey procedures and establishing some exemptions to the survey requirement including setting a cutoff date that will exempt residences built on or after that date from the survey requirement.
This rulemaking responds to direction from the Legislature in SB 705, adopted this session. The bill requires DEQ to adopt rules requiring an asbestos survey be performed before a residential building can be demolished. The bill also requires the rules to establish a cut-off date that exempts buildings constructed after a certain date from the survey requirement.

EQC action

The EQC adopted temporary rules concerning residential asbestos surveys on December 9, 2015. The EQC adopted a permanent version of these rules on April 20, 2016.
