OAR 340-100-0020 and -100-0020 authorize DEQ to remove a listed hazardous substance from that classification on petition if DEQ finds the substance does not meet the criteria to be listed. DEQ previously found that a waste produced in Selmet's facility should be categorized as an F006 listed hazardous waste. Selmet has petitioned DEQ to reverse that decision on the grounds this waste does not meet the criteria to be classified as F006 listed hazardous waste. DEQ conducts the petition process through a rulemaking. DEQ has concluded these wastes do not need to be classified as hazardous and is therefore conducting this rulemaking to delist the specified substances from being categorized as hazardous.
