Composting 2019 Temporary Rule

DEQ is proposing a temporary rule affecting solid waste composting. Currently, OAR 340-096-0140 imposes inconsistent pathogen reduction requirements for digesters located at agricultural locations, in contrast with those located at non-agricultural locations. These inconsistencies impose an undue financial burden without providing an equivalent environmental benefit. The proposed temporary rule would provide an exemption from the pathogen reduction testing limits for liquid digestate from manure digesters not located at agricultural operations.

As a temporary rule, the proposed changes would be effective for a maximum of 180 days. DEQ staff are working on a proposed permanent rule amendment to implement the same changes as proposed in the temporary rule. They intend to bring that proposed permanent rule for commission consideration and action in 2019.

The public comment period for this rulemaking closed at 4 p.m. on Thursday, Feb. 14, 2019.

DEQ will not consider any comments submitted after that time on that date.
