Climate Protection Program development

The Oregon Department of Environmental Quality is conducting a rulemaking to establish a new Climate Protection Program to reduce greenhouse gas emissions and address the effects of climate change. The objective of the Greenhouse Gas Emissions Program 2021 Rulemaking is to:

  • Establish a new program to set limits on greenhouse gas emissions from significant sources in Oregon, including large stationary sources, transportation fuels, and other liquid and gaseous fuels;

  • Define regulatory applicability and program requirements; and

  • Prioritize equity by promoting benefits and alleviating burdens for environmental justice and impacted communities.

DEQ has contracted with ICF to conduct a study to inform program options and advisory committee discussion. More information is available on our Modeling Study on Program Options to Reduce Greenhouse Gas Emissions page.

Public hearings

DEQ plans to hold two public hearings. Anyone can attend the hearings. The hearings are by webinar and teleconference only. Anyone can provide oral comment at a hearing.

Due to the high level of interest and limited amount of speaking time, DEQ requests each commenter provide oral comment at one hearing only and that the comment be limited to two minutes. A portion of each hearing will be reserved for pre-registered commenters. Time will also be available for commenters who do not pre-register. Details on hearings and pre-registration are below.

​DEQ is convening an advisory committee to provide diverse perspectives on policy proposals, including fiscal, environmental justice, public health and economic impacts. DEQ will not seek consensus from the committee, nor will the committee be asked to vote, on specific issues. The committee’s discussions will be used by DEQ in forming its draft rules.

Advisory committee meetings are open to the public. The public may attend the meeting, but the committee has discretion whether to allow the public to participate in the meeting. The public will be able to comment on the proposed rule changes during the public notice and comment period later in the rulemaking. ​Public involvement

In response to multiple requests for extension of the comment period, DEQ extended the public comment period by 21 days in order to allow an additional opportunity to submit data, views or arguments concerning the proposed rules. As a result of this action, the deadline for comments was extended from Oct. 4, 2021 at 4 p.m. to Oct. 25, 2021 at 4 p.m. The comment period for this rulemaking is now closed and comments received will not be considered.
