Thursday, Nov. 14, 2019: 8:30 a.m. to noon; off-site tour in the afternoon

Meeting open and welcome
​Chair George will convene the commission, open the meeting and review the day's agenda.

The commissioners will take action on the proposed draft minutes from the Sept. 26-27, 2019, regular EQC meeting.

DEQ will present updates about general budget and legislative information and provide an overview of the budget and legislative development processes for the 2021 Legislative Session. 

DEQ will present information about federal actions or proposals that could result in a roll-back of specific environmental laws or protections, per the conditions of Oregon's Environmental Protection Act (2019).

Director Whitman will present verbal and written updates on agency activities and issues of interest to the commission.

DEQ and Oregon Department of Justice staff will present a request for commission authorization to include Solid Waste complaints, derived from the Oregon Solid Waste Management statute (ORS 459), in a filing in Multnomah County regarding environmental law violations at a facility in northeast Portland.

Item F: Public forum: Time certain start at 11 a.m.
The commission will open an opportunity for public comment, both in-person and by toll-free telephone line, at approximately 11 a.m. This item is scheduled to last approximately 60 minutes; however, all times are subject to change based on commission needs. Each person wishing to present comment is asked to limit their comments to three minutes or less.

Recess public meeting
The commission will recess the public meeting at approximately noon. 

Working lunch and executive session
The commissioners, DEQ staff and Oregon Department of Justice staff will meet for an executive session over a working lunch from noon to 1:30 p.m. This executive session is held under the authority of ORS 192.660(2)(f) and (h).

​G. Tour: Bonneville Dam
Commissioners, along with staff from DEQ, will tour Bonneville Dam from 1:30 to 5:30 p.m.

Commissioners and some staff from DEQ will gather on Thursday evening for a social dinner. No business will be conducted at the dinner.

Item H, Informational item: Tour debrief
Commissioners will discuss the Thursday afternoon tour of Bonneville Dam and address any follow-up questions or discussion.

Item I, Informational item and comment opportunity: Total Dissolved Gas standard revisions

  • Time certain start: 9 a.m.
DEQ will present information regarding a proposed modification to the Total Dissolved Gas standard for the mainstem Columbia River, scheduled for commission consideration in January 2020. Following the brief staff presentation, the commission will accept comment on the proposed modification.
  • The comment opportunity is scheduled to last 30 minutes; however, the commission may shorten or extend any item at its discretion
  • All people presenting comment are asked to limit their comments to three minutes or less

Item J, Informational item: Water Quality 1200-Z permit
DEQ will present an update on the development of the 1200-Z permit, a Water Quality Division permit for industrial stormwater discharges. 

DEQ will present about the agency's Emergency Response Program, including its roles and responsibilities, funding mechanisms and both near- and long-term planning.

DEQ will propose revisions to rules for the Heating Oil Tank Program, including proposed fee increases.

DEQ will propose​ to de-list specific wastes, currently subject to hazardous waste handling and disposal requirements, produced at the Pacific Cast Technologies facility in Albany, Oregon.

Lunch: The commission will recess for lunch from 12:20 to 1:15 p.m. 

DEQ will propose revisions to rules for the Vehicle Inspection Program, which operates in the Portland and Medford metropolitan areas, including proposed fee increases.

DEQ will present an update of the Hazard Index rulemaking, part of the Cleaner Air Oregon Program.

DEQ will present information about the state's Regional Haze Plan and Program. DEQ will update the Plan over the next 18 months, and bring a final updated Plan for commission review and action in 2021.

Commissioners will provide verbal updates on their recent EQC-related activities and other items of interest for the commissioners and agency.

Adjourn: The commission will adjourn at approximately 3 p.m.
