423rd regular meeting of the Oregon Environmental Quality Commission

The Oregon Environmental Quality Commission met November 17 and 18. The meeting was held at the Beaverton City Council Chambers on Thursday, November 17, and the DEQ Portland offices on Friday, November 18, with access available through Zoom or toll-free telephone connections on both days.


Thursday, November 17: Working lunch and executive session 12-1 p.m.
Working lunch and executive session
The commission will have a working lunch and executive session, held pursuant to ORS 192.660(2)(f) and (h). Executive session is a closed meeting for commissioners, specific DEQ staff and staff from the Oregon Department of Justice, to discuss confidential legal information and updates. Per state law, members of the media may attend executive session; however, they may not report on the specifics or details of any discussions or information presented during executive session.

The commission will convene the public meeting and review the day's agenda.

Item A: Draft meeting minutes (Action)
The commission will review and take action on draft minutes from recent EQC meetings.

Item I: Director's recruitment update (Informational)
Chair George, Commissioner Kile and DEQ staff will present a short update on the recruitment process and timeline for the DEQ Director.

Item B: Climate Protection Program temporary rules (Action)
DEQ will propose temporary rules for commission action to revise the Climate Protection Program.

2:30 p.m.
Item C: Transportation system electrification updates (Informational)
DEQ and invited co-panelists will present an update on the electrification of Oregon’s transportation systems.

3:30 p.m.
Item D: Public forum
The commission will open an opportunity for general public comment on environmental and public health issues of interest to EQC and DEQ. This item is scheduled for up to one hour.
  • Sign-ups to present comment will occur at the start of this item
  • People are asked to limit all comment to three minutes or less
    • This time limit may be reduced if the number of people requesting to present comment would exceed the allotted item time 
    • The commission will affirm commenters' time once sign-ups have occurred at the meeting
  • Comments may not be presented on rulemaking items for which DEQ has held and closed a comment period. For this meeting, that limit applies to:
    • Air Quality Permitting Program rule updates
    • Hazardous Waste rule updates
    • Advanced Clean Cars II rules
    • Waste Tire rule updates

Recess - The commission will recess until 9 a.m. on Friday, Nov. 18, 2022.
Commissioners may attend an informal, optional dinner following recess of the meeting. No commission business will be conducted at dinner.

Item E: Hazardous Waste Program rules (Action)
DEQ will propose rules for commission action to update the Hazardous Waste Program.

DEQ will propose rules for commission action to update the Air Quality Permitting Program.

10:20 a.m.
Item G: Updates to the DEQ/ODA Water Quality Memorandum of Agreement for Nonpoint Source Pollution (Informational)
DEQ and the Oregon Department of Agriculture will present the final proposed Memorandum of Agreement and highlight differences from the previous MOA, as well as summarize public input received. The final MOA is scheduled to be signed by the DEQ and ODA Directors at the end of 2022.

Item H: Director's report (Informational)
DEQ will present written and verbal updates on agency activities and other issues of interest to the commission.

Item J: Delegation of rulemaking authority for 2022 Asbestos Fee rules (Action)
EQC legal counsel will present an updated request for delegation of rulemaking authority for specific proposed rulemaking items, to name Interim Director Feldon as delegated signatory.

Item K: Commissioner reports (Informational)
Commissioners will provide verbal updates on their activities and work of interest to the commission and DEQ. 

12:15 p.m. - Adjourn
The commission is scheduled to adjourn at 12:15 p.m.
