The Environmental Quality Commission adopted amendments to DEQ's Hazardous Waste Program rules This included adoptions of EPA's Definition of Solid Waste, 2015 Revision to the Definition of Solid Waste and 2018 Response to Vacatur of Certain Provisions of the Definition of Solid Waste (80 FR 1694-1814 – Jan 13, 2015, effective Jul 13, 2015 & 83 FR 24664-24671 – May 30, 2018, effective May 30, 2018) to maintain authorization to administer the program in Oregon in lieu of EPA.

During the 2021 legislative session, Senate Bill 57 passed and was later signed into law by the Governor. The new law modernizes and streamlines ORS 465.376, which governs disposal fees, also called “tipping" or “tip" fees, for wastes disposed of in Oregon's only commercially permitted RCRA Subtitle C Hazardous Waste Landfill, Chemical Waste Management of the Northwest, located in Arlington. New fees were set in statute along with the ability to change specific fees by rule. Revenue from these fees partially supports both the Hazardous Waste and Cleanup Programs. These changes went into effect on Jan. 1, 2022; this rulemaking is simply “housekeeping" to align with the statute.

The comment period closed at 4 p.m. on Aug. 31, 2022.

Public hearings
DEQ held two public hearings. The first was held Aug. 17, 2022 and the second was held Aug. 18, 2022.

The Oregon Environmental Quality Commission adopted these rules at it's meeting on Nov. 18, 2022.
