It is my great pleasure to present the Jonathan U. Newman Legal Citizen of the Year award to Justice Hans Linde. 

You’ve already heard that Justice Linde has had a distinguished career as a teacher, scholar, and judge. He is the “intellectual godfather” of the revival of state constitutional law.

We also know Justice Linde as the pioneer of Oregon’s constitutional doctrines governing the rights of prisoners, search and seizure, equality of treatment, and free expression, to name just a few.

I know Justice Linde as a colleague on the Oregon Law Commission, a body on which he served until 2009.  I could tell you that I valued Justice Linde’s profound insights and significant contributions as a member of the Law Commission.  But, if I’m being completely honest, I’ll confess that I was always terrified when testifying before the Law Commission because, every time, Justice Linde would ask me probing questions about family-law or juvenile-law — my areas of practice as a lawyer — questions that, invariably, I couldn’t answer.

So, Hans, you can add to your list of extraordinary achievements that you successfully intimidated a future Governor!

At this moment in our politics, I would be remiss if I did not mention something that makes this award all the more significant. 

Hans Linde is not just a brilliant scholar and a historic jurist; Hans Linde is also: a refugee.  The Linde family fled Germany and then Denmark to escape the Holocaust. They finally settled here, in Portland, where Hans attended Lincoln High School and Reed College — and, in time, became a giant of the law. 

Hans is living testament to what immigrants can become when given the opportunity. You exemplify just how much immigrants contribute to our communities, to the State of Oregon, and to our country. Thank you, Hans Linde, for your intellectual leadership, for your compassionate compass, and for your example.
