Metro Urban Rural Reserves

Background

The Department of Land Conservation and Development (DLCD) issued a Land Conservation and Development Commission (LCDC) order approving the Metro Urban and Rural Reserves on August 14, 2012 for Washington, Clackamas, and Multnomah counties. The LCDC order was appealed to the Oregon Court of Appeals by several parties (Barkers Five, LLC v. LCDC). The Court issued its opinion on February 20, 2014, reversing and remanding LCDC's approval. The Oregon Legislature resolved the issue of urban and rural reserves in Washington County with HB 4078 in 2014. LCDC remanded the matter to Metro and the counties with an order issued January 15, 2015.

Introduction

On July 24, 2017, Metro, on behalf of itself, Clackamas County, and Multnomah County submitted the response to the remanded urban and rural reserves to the Department of Land Conservation and Development (DLCD) for review. The submittal was determined to be complete. Those who participated in the local proceedings received notice of the adoption from the city and were allowed 21 days to submit an objection to DLCD. DLCD received seven objections (see "Objections," below).

The DLCD director must approve or remand the submittal, or refer it to the Land Conservation and Development Commission (LCDC). (See OAR 660-025-0150.) The director referred the submittal to LCDC for consideration at its November 17, 2017 meeting.

Department Report

The director of the Department of Land Conservation and Development issued a report explaining the results of the department's review of the urban and rural reserves submittal on October 26, 2017.

LCDC Decision

LCDC conducted a hearing on the Metro Urban and Rural Reserves on November 17, 2017. After receiving argument and testimony from Metro, Clackamas County, Multnomah County, and objectors, the commission deliberated and approved the submittal. The LCDC order approving the Metro Urban and Rural Reserves was issued on May 16, 2018.
