Rulemaking at ODA

Rulemaking is how the government creates or updates rules.  These rules are like instructions that explain how to follow laws. They can be added, changed, or removed; either for a short time or permanently.  

Rulemaking Process

  1. Rulemaking can start in three ways: by ODA staff, a public petition, or the Oregon legislature.
  2. Draft rules are usually reviewed by a rules advisory committee (RAC), sometimes more than once.
  3. The public can give input on proposed rules when they are published in the Oregon Bulletin, on the ODA rulemaking webpage, and through the ODA rulemaking email list
  4. A public hearing, usually held online, is scheduled so people can share their thoughts. Written comments are also accepted until a set deadline. 
  5. After reviewing public input, the ODA Director decides if changes are needed.
  6. Once final, the permanent rules are filed with the Oregon Secretary of State, completing the rulemaking process.

Rules in Progress

This section provides information on rules that are being developed. Before proposed rules are filed for public comment with the Oregon Secretary of State, one or more Rules Advisory Committee (RAC) meetings are usually held. RAC meetings are open for the public to observe, but only invited members take part in discussions. Meeting materials are available to the public as the rulemaking process moves forward, as explained at the top of this page.
