in which 0:07:42.160,0:07:49.159 the SEA is informed about the potential 0:07:45.159,0:07:52.000 non-compliance so that clarity is even 0:07:49.159,0:07:54.240 if ODE finds out outside of traditional 0:07:52.000,0:07:56.199 monitoring and supervision activities 0:07:54.240,0:07:59.520 about potential non-compliance we are 0:07:56.199,0:08:02.960 required to investigate and respond um 0:07:59.520,0:08:05.520 so taking that clarification from USDE 0:08:02.960,0:08:08.000 in mind um there are several test and 0:08:05.520,0:08:11.159 propriety categories as you know um that 0:08:08.000,0:08:12.240 may constitute an IDEA non-compliance 0:08:11.159,0:08:17.440 which would be not following the 0:08:12.240,0:08:20.759 students IEP um those common ones are um 0:08:17.440,0:08:22.159 not providing uh the accessibility 0:08:20.759,0:08:24.960 supports that are outlined on a 0:08:22.159,0:08:27.520 student's IEP or administering the wrong 0:08:24.960,0:08:29.599 assessment so if the students IEP says 0:08:27.520,0:08:33.519 you're supposed to administer Extended 0:08:29.599,0:08:36.599 and you administer the general or vice 0:08:33.519,0:08:40.159 versa uh so now with the new impropriety 0:08:36.599,0:08:42.440 form DTC's are being asked to determine 0:08:40.159,0:08:44.920 whether the circumstances of your test 0:08:42.440,0:08:47.080 in propriety was a possible IDEA 0:08:44.920,0:08:48.399 non-compliance uh we will review that 0:08:47.080,0:08:52.519 information 0:08:48.399,0:08:55.080 provided um just to to right size the 0:08:52.519,0:08:58.200 issue we expect that the majority of 0:08:55.080,0:09:00.920 incidents will be corrected through the 0:08:58.200,0:09:02.360 test impropriety process so the most 0:09:00.920,0:09:05.959 common thing 0:09:02.360,0:09:09.360 is we didn't have the support set and 0:09:05.959,0:09:11.480 TIDE and we started the assessment which 0:09:09.360,0:09:13.920 would bring you out of compliance with 0:09:11.480,0:09:17.120 IDEA through the test impropriety 0:09:13.920,0:09:19.399 process we reset the test and then you 0:09:17.120,0:09:21.279 administer the test correctly according 0:09:19.399,0:09:23.680 to the students 0:09:21.279,0:09:27.040 IEP which would then bring you back into 0:09:23.680,0:09:30.120 compliance so we expect that to be the 0:10:19.720,0:10:25.120 some sort of IDEA non-compliance 0:10:22.279,0:10:27.560 and we just had to totally invalidate 0:10:25.120,0:10:29.360 the students test so you can't go back 0:10:27.560,0:10:33.959 and readminister it according to the 0:10:29.360,0:10:35.839 students IEP um then we would have to um 0:10:33.959,0:10:37.600 like I said again work with the IDEA 0:10:35.839,0:10:39.760 Programs District Support Specialist to 0:10:37.600,0:10:41.440 figure out then what what would that 0:10:39.760,0:10:43.639 corrective action be because it wouldn't 0:10:59.079,0:11:05.480 incorrect accessibility 0:11:01.000,0:11:08.519 settings um and this does not include 0:11:05.480,0:11:10.600 um uh this does not include domain 0:11:08.519,0:11:12.320 exemptions on ELPA so we kind of 0:11:10.600,0:11:14.920 categorized those differently last year 0:11:12.320,0:11:17.639 so this is just accessibility settings 0:11:14.920,0:11:20.200 um so like I said 492 tests were 0:11:17.639,0:11:22.600 impacted last year um of course not all 0:11:20.200,0:11:26.120 of these students had IEPs so we're not 0:11:22.600,0:11:30.360 expecting 492 of these potential IDEA 0:11:26.120,0:11:34.600 non-compliance but of those 492 test 0:11:30.360,0:11:37.079 471 of them were reset so that's kind of 0:11:34.600,0:11:38.959 so as I'm saying we're expecting the 0:11:37.079,0:11:42.320 majority to just be handled through the 0:11:38.959,0:11:44.399 process but we need to investigate and 0:11:42.320,0:11:46.480 we need to have a formal response to the 0:11:44.399,0:11:50.040 district saying hey we looked into this 0:11:46.480,0:11:52.480 you're going to fix it um of those 492 0:11:50.040,0:11:55.480 17 were invalidated and one was
