Notice of Upcoming Rulemaking for the Board of Cosmetology and the Board of Certified Advanced Estheticians

The Health Licensing Office (HLO), the Board of Cosmetology, and the Board of Certified Advanced Estheticians intended to file a Notice of Proposed Rulemaking (Notice) with the Secretary of State for publication in the August 1, 2023, Oregon Bulletin, but time constraints did not allow HLO to do so.

The Notice will now be filed with the Secretary of State's Office for publication in the September 1, 2023, Oregon Bulletin. The notice will include the proposed rule text, a statement of need and fiscal impact, and a racial equity statement. Public comment will be accepted from September 1 through October 6, 2023, at 5 p.m. A public hearing has been scheduled for September 19, 2023, from 9 a.m. through 1 p.m. Attendance through MS Teams will be available for the public hearing as well as in person at the HLO location. Further information and a link to the public hearing will be provided on the Notice, which will be emailed to all authorization holders and interested parties.

Anyone submitting public comment prior to September 1, 2023, must resubmit the comment on or after September 1, 2023. Any public comment received after October 6, 2023, will not be considered by the Board's or the HLO.

Both Boards are expected to consider public comment and the hearing officer report before adopting permanent rules at the October 23 and 24, 2023, joint board meetings. Details regarding the joint meetings will be provided at a later date.

The rules being proposed include, but are not limited to:

  • Definition of device for esthetics
  • Definition of natural physiological effect and epidermis
  • Definition of device for advanced esthetics
