Civil Commitment
Enabling Legislation: ORS 426.701 and 702
In 2013, SB 421 became law (ORS 426.701 and 702) which created a new type of civil commitment category placing some individuals who are civilly committed under the Board's jurisdiction.  Specifically, a district attorney may petition the court initiate commitment proceedings for those persons who have committed certain types of serious acts and have certain types of mental disorders that cause them to present a serious danger to the safety of other persons by reason of an extreme risk that the person will inflict grave or potentially lethal physical injury on other persons and who are found unless committed, would continue to represent an extreme risk to the safety of other persons in the foreseeable future.
