NOTICE OF PROPOSED RULEMAKING

TEACHER STANDARDS AND PRACTICES COMMISSION
December 13, 2018
 
On November 1, 2018, the Teacher Standards and Practices Commission voted to refer the following proposed rules for public comment.  Public comment on the proposed rulemaking will be accepted until 5:00 p.m. on January 25, 2019.
 
The agency has scheduled a public hearing on the proposed rules for January 15, 2019 at 4 p.m. at the TSPC Salem Office: 250 Division St. NE Salem, OR 97301.
Comments on the proposed rules should be emailed to
prior to January 25, 2019 at 5 p.m.
 
The proposed rule changes will be considered for permanent rulemaking at the Commission’s meeting on February 7-8, 2019 in Salem, Oregon.

Preliminary Teaching License
Removes six-year recency requirements from the Preliminary Teaching License rule.  Recency for Preliminary Teaching License will continued to be monitored through the programs.  (584-400-0160  requires applicants to submit a program recommendation that is no more than three years old.  If the program recommendation is more than three years, the applicant must obtain a new recommendation from their program.) Makes other technical changes.

Restricted Teaching License
Provides the option of moving to the Reciprocal Teaching License after the last term of the Restricted Teaching License for educators completing out of state programs.  Requires licensure on the 91st day after application to align with the provisions of SB 205.

Includes reinstatement fees for substitute licenses. Clarifies when a lapsed district-sponsored license will require PDUs upon application for the same type of district-sponsored license (e.g. the Legacy Teaching License).

Reciprocal Administrator License
Adopts rule for the Reciprocal Administrator License.  The purpose of this license is to allow an out-of-state or out-of-country licensed administrator to transition into the Oregon licensure system based on the credentials they earned in the other jurisdiction.

Adopts rule for the Restricted Administrator License.  The purpose of this license is to allow a teacher, school counselor, school social worker or school psychologist to serve as a building-level administrator while they complete the requirements for the Principal License.  The Restricted Administrator License requires school district sponsorship.

Adopts rule for the LCA for Professional Administrator License.  The purpose of the LCA is to allow a holder of a Principal License to serve in a district-level administrator position in their sponsoring school district while they complete the requirements for the Professional Administrator License.

Teacher Candidate Performance Assessments
Requires EPPs to require preservice candidates to complete a Commission-adopted teacher performance assessment as required in the Program Review and Standards Handbook. Allows for a work sample which confirms to rule in endorsement areas where the Commission has not adopted a performance assessment. Removes previous language regarding the transition to the candidate performance assessment now that consequential date for meeting the assessment standard has now been reached. Provides for the Commission to later adopt other assessments which can be utilized to meet the performance assessment requirement to be included at such time within the Program Review and Standards Handbook.

Candidate Program Completion and Recommendation
Includes the requirements of Educator Preparation Programs to recommend licensure. Removes references to civil rights and ethics exam and replaces it with civil rights and ethics requirements. Provides for future alternative methods of demonstrating competencies of various licensing requirements to be adopted by the Commission and included in the Program Review and Standards Handbook.

Waiver of Program Requirements
Rule allows for Educator Preparation Providers (EPPs) to waive certain licensure, endorsement, or specialization requirements; and provides the process for doing so. Reaffirms that EPPs may not waive clinical practices for pre-service candidates in the endorsement area in which they are completing their edTPA. EPPs cannot waive required teacher performance assessments and demonstration of content knowledge in the area of endorsement and U.S. and Oregon civil rights laws and professional ethics as adopted by the Commission and included in the Program Review and Standards Handbook. Provides for future alternative methods of demonstrating competencies of various licensing requirements to be adopted by the Commission and included in the Program Review and Standards Handbook.
