The State Conciliation Service provides mediators to assist parties in resolving unfair labor practice complaints which are filed with the Employment Relations Board pursuant to ORS 243.672. Mediation of unfair labor practice disputes is voluntary and all parties must agree for mediation to occur.
Mediation of unfair labor practice disputes provides the parties with an alternative to the uncertainty and cost inherent in the hearing process. During 2013-2015, 82% of unfair labor practice cases mediated by the Conciliation Service resulted in settlement.
Parties to an unfair labor practice dispute who would like to pursue mediation should ask the administrative law judge assigned to the complaint to transfer the case to mediation. The administrative law judge will contact the Conciliation Service for the parties and the State Conciliator will assign a mediator and schedule the matter for mediation.
Unfair labor practice complaint mediation services for State of Oregon agencies and bargaining units are funded through interagency assessments. Unfair labor practice complaint mediation for local government agencies and bargaining units are provided through a fee of $250 from each party.
