Proposal to renew NPDES General Permit #01 and issue new WPCF General Permit #01 for CAFOs (Public comment extended until 5 p.m., Friday, May 30, 2014)

What is proposed?

ODA and DEQ propose to:

  • Renew CAFO National Pollutant Discharge Elimination System (NPDES) General Permit #01 that expires on May 31, 2014. 
  • Issue a new CAFO Water Pollution Control Facilities (WPCF) Permit #01.

Both of these permits regulate manure, litter, and process waste water generated by confined animal feeding operations (CAFOs) to protect surface water and groundwater of the state. NPDES General Permit #01 allows a CAFO to discharge of pollutants to surface water in rare circumstance; only during large storm events (25-year, 24-hour storm event) provided the discharge complies with water quality standards and the CAFO is being operated according to permit requirements. WPCF General Permit #01 prohibits discharge to surface water and requires that the CAFO comply with permit requirements that are similar to the NPDES General Permit #01.

Owners and operators of CAFOs and residents in the vicinity of CAFOs may be affected by these permit actions.

  • Oregon Revised Statute 468B.050(1)(d), Oregon Administrative Rule (OAR) Chapter 340, Div. 40, 41, 45, and 52, and OAR Chapter 603, Div. 74 apply to both permits.
  • Title 40 Code of Federal Regulations (CFR) Parts 122 and 412 for the NPDES general permit.
