NOTE:

In accordance with Oregon Revised Statute (ORS) 192.420, every person has the right to inspect any nonexempt public record of a public body in Oregon. The Oregon State Treasury (OST) will fully comply with this law and will respond to public records requests as detailed below. 

Public records are writings containing information relating to the conduct of the public's business. Writings include handwritten, typed, photographed, electronic and otherwise recorded words, letters, pictures, sounds, symbols or combinations thereof (ORS 192.410). State law exempts some public records from disclosure. (ORS 192.410 to 192.505) Public bodies are not required to explain or answer questions about their public records, nor are they required to create public records where none exist. Public bodies are required to make available for inspection and copying, subject to any applicable exemptions, only those records that exist at the time of the request. 

In accordance with OAR 170-061-0015(3) the timing of OST’s response to a public information request depends on the nature and extent of the request. 

OST will provide the estimated costs involved in fulfilling the request, the date the information is expected to be available for review, pickup or mailing, or to advise that the request is denied. If the request to review the public record(s) is denied, a written explanation of the reason for denial will be provided. Estimated costs may include the locating, copying, redacting exempt information, certifying, mailing or other administrative costs incurred to provide the records. Public records requests are only processed after payment for the estimated cost is received. The payment is due regardless whether or not records are found, or if found, the records are exempt from disclosure and cannot be provided. 

 Most records held at OST are property of the OST. No information of record may be altered, added to, or removed. The inspection or copying of public records in the custody of OST is not meant to waive or restrict any copyright, proprietary, confidentiality, privilege, exemption of disclosure, or other rights in said documents.

I further agree to pay the cost of fulfilling this Public Records Request according to the conditions set forth above and as established in the fee schedule adopted by the OST.
