Online Advertising Requirements

June 2024

The Oregon Real Estate Agency (OREA) understands that online advertising is a vital tool for real estate professionals. This provides an overview of the key requirements you must follow when advertising online, ensuring compliance with Oregon Administrative Rule (OAR) Chapter 863.

General Advertising Requirements

  • Authorization: When representing a seller, ensure the listing agreement authorizes you to advertise the property.
  • Registered Business Name: All advertisements must prominently display your company name exactly as it is registered with the OREA.
  • Truthful and Not Misleading: All advertising materials must be accurate and avoid any deceptive or misleading information.

The "One-Click" Rule for Online Ads

In addition to the general advertising requirements, online ads must also include your licensed or registered alternative name. We understand that character limitations on some social media platforms can make it challenging to include both your name and your registered business name within the initial advertisement.

To address these limitations, the administrative rules allow a "one-click" approach. All required information, including your name and the registered business name, must be clearly displayed on the landing page that opens once a consumer clicks on your ad. In essence, the complete information must be readily available with just a single click.

Team Advertising

While displaying your team name within your online advertisements is permitted, it is not mandatory.

We encourage you to review ORS chapter 696, OAR 863-015-0125, and OAR 863-025-0125 for an understanding of all regulations. If you have any questions, please don't hesitate to contact at orea.info@rea.oregon.gov.
