Real Estate Teams in Oregon – What You Need to Know

A new law that took effect January 1, 2026, now governs how teams must operate, advertise, and serve clients. If you work on a real estate team, or are thinking about starting one, here’s what you need to know.

What is a Real Estate Team?

According to ORS 696.370, a real estate team is a group that:

  • Works under a name different from the brokerage's Registered Business Name (RBN)
  • Operates as a group within the RBN
  • Consists of one or more brokers or principal brokers who are associated with the same managing principal broker.

In short, if your group operates under its own name within a brokerage, you are a team under the new law, and the requirements below apply to you.

Key Requirements

Get Approval from Your Managing Principal Broker

Even if your team has been operating for years, make sure your managing principal broker has officially approved your team.

Use the New Team Disclosure Form

Before signing any agreement with a client, you must give them the Real Estate Team Disclosure Form from the Oregon Real Estate Agency (OREA). This form includes:

  • Your managing principal broker’s name and the RBN
  • Names and roles of all team members
  • Which team members are licensed and which are not
  • Who supervises the team
  • A statement that if your team represents both sides of a deal, a disclosed limited agency agreement must be in place

Check Supervision

If someone on your team supervises others, they must be a managing principal broker or a principal broker with a written supervisory agreement with the managing principal broker. This ensures that anyone in a supervisory role has authority and accountability as required by law.

Review Your Advertising

All team advertising must:

  • Clearly show the name of the RBN
  • Not suggest the team is a separate company
  • Clearly identify licensed and nonlicensed members if both are named
  • Follow all other advertising rules found in Oregon Administrative Rule (OAR) 863-015-0125

Real Estate Team Names

Starting July 1, 2027, real estate team names cannot include the terms “real estate” or “realty.” Existing teams will need to rebrand by that date.

Disclosed Limited Agency Agreements

Before a member of your team can represent both a buyer and a seller in the same transaction, or two or more buyers interested in the same property, the team must have a disclosed limited agency agreement in place with all parties.
