The Department of State Lands will be accepting public comment on the following rulemaking activities:​

​​Deschutes / Crook Counties Land Closures
This rulemaking will amend the Department of State Lands public recreational use rules for three parcels of state-owned land in Deschutes and Crook County.  On October 14, 2014, the State Land Board approved the Department’s request to initiate rulemaking for this parcel.  The Department has been closely monitoring these parcels with the assistance of law enforcement, adjacent landowners and other affected stakeholders. ​​Essential Salmon Habitat (ESH)
Streams that are designated as ESH are those necessary to prevent the depletion of indigenous anadromous salmonid species during their life stages of spawning and rearing.  ESH also includes off-channel rearing or high-flow refugia habitat with a permanent or seasonal surface water connection to an ESH stream.  According to OAR 141-102-0040, the Department must consult annually with the Oregon Department of Fish and Wildlife (ODFW) on the accuracy of the ESH designations and revise the maps to reflect the best available data and the newest version of Fish Habitat Distribution Data Standard. This update resulted in addition of new stream reaches and deletion of others. There was a net increase of 500 stream miles (or roughly 3%) over the current 2010 ESH designation. The public comment period CLOSED November 28, 2014 @ 5:00 PM.

​​General Authorizations / Removal-Fill​
Division 85 rules govern the issuance and enforcement of removal-fill authorizations within waters of the state including wetlands. Revisions to these rules are necessary to clarify provisions and meet statutory changes from the 2013 legislative session (HB2396 and HB2032​, both enrolled). The public comment period CLOSED Thursday, July 31, 2014 at 5:00 PM. The final rules were filed with the Secretary of State's office and are effective as of September 1, 2014.

​​Special Use Rules / Geothermal Resources​
​​The Department of State Lands will repeal the administrative rules governing the exploration for and development of geothermal resources (OAR 141-075-0010 through 141-075-0575). The content of these rules will be added to the special use rules to include the exploration for and development of geothermal resources (OAR 141-125). The first public comment period CLOSED Friday, June 13, 2014 at 5:00PM.

The Department opened the draft rules for a second public comment period.  The purpose was to allow for any new or additional input on the draft rules to be incorporated into the record. The public comment period was open from October 1, 2014 until October 15, 2014 5:00 PM.​
