A worker’s compensation premium audit dispute usually happens after you receive a bill or a final audit that you believe is incorrect. Common issues include payroll amounts, worker classifications, or whether certain workers should have been included.
What if I disagree with my premium bill or final audit?
If you believe you may be overpaying for workers’ compensation coverage, take the following steps as soon as possible. Many issues are time sensitive:
Step 1. Contact your insurance company or agent.
Explain exactly what you disagree with, such as the work was assigned to a higher classification code than you expected or payroll was not calculated correctly.
Many disputes can be resolved directly with the insurer once the issue is clearly explained and supporting documents are reviewed.
Step 2. Contact the Office of the Small Business Ombudsman for Workers' Compensation.
If you are unable to resolve the issue with your insurer, contact us. We will review the situation, explain your rights and contact the insurer on your behalf.
We can help work on an informal resolution while also helping you start the formal dispute process to protect your appeal rights. Because there is a 60-day deadline, we often help businesses take both steps at the same time.

Step 3. Consider formal appeal options.
If a formal appeal is needed, our office can explain the process and identity which option will work best for you. Options include requesting an appeal with the Division of Financial Regulation or meeting with the Oregon Workers’ Compensation Review and Advisory Committee (known as ORAC).
Important things to know
Do not wait to act if you disagree with an audit or bill. Missing the 60-day deadline can limit your options. Keep copies of payroll records, contracts, and audit documents; these documents are often needed to resolve disputes.
