Is Your Real Estate Team Compliant?

Real estate team regulation has evolved over the years, and current law now affects how your team advertises, discloses, and operates. If you are a member of a real estate team, here is what you need to know.

Real Estate Team Advertising

Your brokerage's registered business name (RBN) must be immediately noticeable in all team advertising, including websites, social media profiles, yard signs, and print materials. "Immediately noticeable" means a consumer can see it without having to search for it.

Your advertising must also:

  • Not imply the team is a company separate from the brokerage.
  • Not imply that a team member is the managing principal broker unless they are.
  • Clearly identify which members are licensed and which are not, if both are named.

The Agency checks compliance with these requirements at renewal of the RBN.

What Happens at Renewal

When you renew your license, you'll answer questions about whether you are a member of a real estate team, identify where your team advertises, and self-attest that your advertising meets the legal requirements. The Agency reviews these responses and follows up with education when advertising falls short.

Other Real Estate Team Requirements

  • Team Disclosure Form: Before entering into any written representation or listing agreement, team members must provide the Real Estate Team Disclosure Form. Deliver it as soon as you have the client's contact information. OREA offers both a PDF and a Word version (for adding your branding).
  • Supervision: If anyone on your team supervises licensed team members, that person must be either a managing principal broker or a principal broker with a written supervisory agreement.
  • Disclosed Limited Agency: If your team represents both a buyer and a seller in the same transaction, or two buyers interested in the same property, a Disclosed Limited Agency Agreement must be in place with all parties before representation begins.
  • Team members from the same brokerage only: All licensed team members engaging in professional real estate activity must be associated with the same managing principal broker. A person who holds a real estate license at another brokerage may participate on your team in an unlicensed capacity.

Team Name Registration Is Not Currently Available

We have received questions about registering team names with the Oregon Real Estate Agency. At this time, the Agency does not register real estate team names. There is no application, no approval process, and no registering.

Coming in 2027: Drop "Real Estate" and "Realty" from Team Names

Starting July 1, 2027, real estate team names cannot include the words "real estate" or "realty." If your team’s name includes either term, start planning your rebrand now.
