UPDATE - The New LARRC and Fair Housing Requirement

The Oregon Real Estate Agency communicated in the September and December 2021 issues of the Oregon Real Estate News-Journal about House Bill 2703 (Oregon Laws 2021, Chapter 161).

Effective July 1, 2022, if you are a real estate broker, principal broker, or property manager renewing your active license or reactivating your license, you are required to complete a 3-hour Law and Rule Required Course (LARRC) containing instruction in state and national fair housing laws as part of your continuing education.

The 2022-2023 LARRC with the new required content is now available from certified providers.

What if I completed the 2020-2021 LARRC after my last active license renewal?

The 2020-2021 LARRC did not contain the fair housing component required by HB 2703. Since passage of the bill, stakeholders have contacted the Agency requesting an alternative for licensees who completed the 2020-2021 LARRC course for their upcoming license renewal. The Real Estate Board considered this request and approved an alternative. These licensees no longer need to complete the 2020-2021 and the 2022-2023 LARRC in the same license period.

If you completed the 2020-2021 LARRC in preparation for your next active license renewal or reactivation, you may take a supplemental course on fair housing from a LARRC provider to meet the HB 2703 requirement. This applies to licensees renewing an active license or reactivating a license between July 1, 2022, and December 31, 2023. See below for more details.

What education do I need to renew my license as active after June 30, 2022?

Reminder: Only courses completed within the two years prior to your license renewal date count toward an active renewal.

You do not need continuing education to renew your license in an inactive status. When you reactivate your license, you will need to meet continuing education requirements.

How do I know which LARCC I have completed?

LARRC providers must issue certificates of attendance to licensees who complete the LARRC. The certificate will indicate “2020-2021 LARRC" or “2022-2023 LARRC."

Any continuing education hours taken before your last active renewal date will not count toward your next active license renewal.

When do I need to meet the new continuing education requirement?

    • You must meet the requirements of HB 2703 when you renew your active license on or after July 1, 2022. This includes late renewals completed on or after July 1, 2022.
    • You must meet the requirements of HB 2703 if you are reactivating your license after an inactive license renewal if the reactivation is on or after July 1, 2022.

What if I don't meet the new requirements before my license expiration date?

You cannot renew your active license without completing the required continuing education. If you know you will not meet the requirement by your license expiration date, you have two options:

    • Renew your license inactive on time, paying the $150 inactive renewal fee. When you have completed all required education, you can reactivate your license by paying the $150 reactivation fee, entering your continuing education, and having your principal broker add you back to the registered business. You cannot conduct professional real estate activity while your license is inactive.
    • Let your license expire. When you have completed the required continuing education, you can renew late by paying the $300 renewal fee plus the $150 late fee, entering your continuing education, and having your principal broker add you back to the registered business. You cannot conduct professional real estate activity while your license is expired.

If you are the only principal broker in a registered business, you should renew your active license on time. If you inactivate your license or let your license expire, the registered business name becomes void and all associated licensees become inactive. This means the business and its licensees can no longer conduct professional real estate activity. You would then need to meet the requirements for an active license, pay the licensing fee ($300 + $150 late fee), re-register the business name ($300), and pay $10 per license to transfer licensees back to the business.
