Requesting Civil Rights Files
General Information
Once a complaint is filed it is public record.  Anyone may view or get a copy of it.  The investigative file, however, is not public record until after the case closes.  Even after a case closes, the file is subject to public records law and HIPAA regulations.  This means that portions of the file may be unavailable (or exempt) to certain requestors.  Examples of exempt material are social security numbers and medical information.
The retention schedule for most Civil Rights files is 5 years after the date the case closes.  When the retention time is up, the file is destroyed.  The only record available from that point on will be what case information is stored in our database.
The Civil Rights Division will charge a fee for processing requests for copies &/or viewing files.  We also charge for statistical and other records requests.  Our fee guidelines are dictated by OAR 839.030.

Requesting Copies of Civil Rights Division Files

To request copies, to view or get any information, a request in writing must be made to the Civil Rights Division.  A request does not have to be on our form, but it does need to be in writing.  

*Attention Complainant Attorneys: In order to expedite your request and to obtain documents that would otherwise be exempt, please provide a medical release from your client along with your request.

When a request is received, the fee will be determined and notification will be sent to the requestor advising of the cost to process their request.  Requests will not be processed until payment has been received.
Processing copies generally takes 4 - 6 weeks after a payment is received.
