Out-of-State Safety Overview

Out-of-state remote workers follow health & safety rules of their remote work state. Oregon OSHA has no governing authority outside of Oregon.

Health & safety falls under the authority of Federal OSHA. States are allowed to self-administer their own programs. All states must implement rules that meet Federal OSHA minimums. States that are self-administered may have specific rules. These rules may go beyond federal minimum requirements.

The State of Oregon has remote workers in every state.  Agencies will follow rules that meet minimum Federal OSHA requirements. Agencies may not be aware that state-specific rules apply.

DAS Risk Management researched health & safety rules in all remote work states. Some self-administered states have state-specific rules. These rules may apply to out-of-state remote workers. Agencies should review state-specific rules and apply them as necessary.
