These amendments represent the annual readoption of several federal safety regulations on the effective date of April 1, 2024.

Changing the term accident to collision
DMV proposes to amend certain rules to change the term “accident” to “collision” in alignment with 2024 SB 1574.

This rulemaking action amends rules from two ODOT rule chapters - 735 DMV, and 737 Safety. The two notices should be read together to gain a complete picture of the actions being taken.

Transferring Canadian and Mexican CDLs for an Oregon CDL
Previously, Oregon allowed CDL transfers to Mexican and Canadian CDL holders without testing. However, Oregon has become a target for individuals who are fraudulently claiming Oregon residency to be issued Oregon CDLs and avoid the testing or issuance requirements in their home state. DMV is permanently amending its rules to prevent fraud by limiting who is eligible for a CDL transfer.

Variable Speed Zones
This rule amendment reflects changes on Interstate 84 to implement a variable speed zone for eastbound vehicles from MP 211.46 to MP 216.74. This variable speed limit will operate in conjunction with an automatic gate closure system when the interstate is closed at Exit 216 due to weather, crash, or other event east of Exit 216.

Interstate Speed Zones
As amended, this rule will extend the existing 55 mph speed limit zone for all vehicles by approximately 0.25 miles south on Pacific Highway (Interstate 5) in Medford, from MP 27.00 to MP 26.75. This will give drivers distance to adjust their speed before reaching the exit ramp and after entering traffic merges onto the interstate.

Updating public notice requirements for sole source procurements
These changes will align ODOT’s sole source public notice threshold with the threshold in the Attorney General Model Public Contracting rules, OAR 137-047-0275.

Updating veteran language to comply with statute
Amending language in rules that refer to “service-disabled veteran” to comply with HB 2295 (2023)​​

Mediation Confidentiality
ODOT needs to update its mediation confidentiality rule which has not changed since it was adopted in 2007. The agency will be adopting the DOJ model rule by reference.

General provisions related to Public Improvement Contracts for Construction Services
•  Removing language that limits ODOT’s adoption of DOJ Model Rules to the January 1, 2014, version.
•  Adding language to allow the use of a time-stamping machine.
•  Adding language that notes ODOT’s adoption of DOJ Model Rules for Alternative Contracting Methods, except for any DOJ Model Rules applicable to procurements of construction manager/general contractor services that are adopted under ORS 279A.065(3) and ORS 279C.337(1), for public improvements governed by OAR chapter 731, divisions 5 and 7.
