"Show-Up Pay" Or Adequate Work

In years past, Oregon employers had an obligation to provide either adequate work or reasonable compensation to an employee who reported to work for a scheduled shift.  

In 1990, the scope of this requirement was scaled back apply only to the employment of minor employees (individuals under 18 years of age).  Currently, minor employees who are required to report to work must be provided adequate work to earn at least half the amount that would have been earned during the minor’s regularly scheduled hours of work. Otherwise, employers must pay a minor employee for no less than one hour of work or half the scheduled shift, whichever is greater. OAR 839-021-0087(5).

Effective July 1, 2018, Senate Bill 828 (2017), established additional work scheduling standards for certain employers in retail, hospitality, or food services industries that have at least 500 employees worldwide. These standards include the payment of additional compensation for schedule changes without adequate notice.  Please see our fact sheet Predictive Employee Scheduling​ for additional details.
