What the Real Estate Agency regulates

The Agency regulates:

  • Brokers and principal brokers in the course of their professional real estate activity (ORS 696.010).
  • Property managers while managing rental real estate (ORS 696.010).
  • Registered property wholesalers and brokers, principal brokers, and property managers engaging in residential property wholesaling.
  • Unlicensed individuals who collect or attempt to collect a fee for representing a buyer or seller in a real estate transaction.
  • Unlicensed individuals who collect or attempt to collect a fee for managing another person’s rental property.
  • Unregistered and unlicensed individuals who engage residential property wholesaling.
  • The activities of escrow agents (ORS 696.505).

The Agency does not regulate:

  • Contract disputes.
  • Real estate transactions between private parties that do not involving licensees or registrants.
  • Landlord and tenant laws& or disputes between landlords and tenants.
  • Homeowner associations (HOAs) and condo owner associations.
  • The National Association of Realtors® Code of Ethics
If you have a legal dispute or question that the Agency cannot help with, you may need a lawyer. The Oregon State Bar has a lawyer referral service that connects consumers with an attorney for an initial consultation at a reduced fee.
