Background
A new energy efficiency standard is scheduled to apply to small battery charger systems manufactured on or after January 1, 2017. However, an industry association has raised concerns that the statute in question inadvertently encompasses certain electronic products, such as computer servers and scientific equipment, which contain embedded battery chargers for functions such as maintaining data in memory caches. These products could not continue to be sold in Oregon after the operative date, imposing a substantial hardship on manufacturers, retailers and the public. The proposed rule changes would postpone the operative date of the standards for one year, allowing the industry association time to pursue a legislative solution.

Implementation of 2013 Senate Bill 692

Rulemaking Overview

The 2013 Oregon Legislature passed Senate Bill 692, which adds energy efficiency standards for three new appliances sold or installed in Oregon:
  • Televisions (effective Jan. 1, 2014)
  • Battery chargers (effective Jan. 1, 2014)
  • High light output double-ended quartz halogen lamps (effective Jan. 1, 2016).
The Oregon Department of Energy will implement rules to require certification of these 3 appliances.

The Oregon Department of Energy filed permanent rules for Minimum Efficiency Standards for State-Regulated Appliances and Equipment on Monday, Dec. 23, 2013. The rule amendments became effective January 1, 2014.
These permanent rule amendments implement minimum energy efficiency standards for new televisions, battery charger systems and high light output double-ended quartz halogen lamps sold or installed in Oregon, as established by Senate Bill 692, passed by the 2013 Oregon Legislative Assembly. Methods for testing the energy consumption of those three products are described in the rules. The rule amendments also update the list of products now subject to federal energy efficiency standards and therefore no longer subject to state regulation, and update and clarify the certification and compliance requirements for state-regulated equipment. Two sections regarding the department’s authority to postpone, adopt or update minimum energy efficiency standards are repealed as they are redundant with statute.
