Priority System Established For Remaining Renewable Energy Tax Credits

The 2010 Legislative Special Session put a $300 million cap on the amount of potential Business Energy Tax Credits (BETC) available for renewable energy projects. The cap covers the current biennium that ends June 30, 2011. The Oregon Department of Energy (ODOE) has already issued preliminary certificates totaling about $218 million in tax credits.
The BETC program still has funds available for projects using or producing renewable energy. However, a new tiered priority system will open June 1, 2010 with $60 million of the approximately $82 million in cap available for the funding cycle June 1, 2010 through December 31, 2010.
Once projects are selected, started and/or completed, ODOE will indentify the available funds for the next funding cycle January 1, 2011 through June 30, 2011. Like the $300 million cap on renewable energy tax credits, the tiered system was established by HB 3680 in the 2010 Special Session.
Of the approximately $218 million in preliminary certificates tax credits already issued: $83 million is for solar electric (photovoltaic) projects, $51 million for wind, $35 million is for biomass, $28 million for hydro projects, $10 million for Research, Development and Demonstration (RD&D) cellulosic ethanol, $8 million for geothermal, and $3 million for solar thermal. These numbers are approximate because not all projects go forward to completion for a variety of business reasons.
“The numbers show that the renewable program is working and quality projects are moving forward,” said Oregon Department of Energy Director Mark Long.
The new tiered priority system will mean closer examination of applications and involve comparing projects of similar costs, prior to ODOE approval. “The new system is similar to a grant model where ODOE will announce available funding and make selections based on the best applications and best value for Oregon taxpayer money,” said Long.
The $60 million in funds released June 1, 2010 will cover:

Tier 1: $10 million available for applications requesting less than $250,000 in tax credits, processed on a first come basis.

Tier 2: $20 million available for applications of $250,000-$2,999,999 in tax credits. These will be subject to a competitive review with two funding periods of $10 million each (June 1-August 31, 2010 and October 1-December 31, 2010).

Tier 3: $30 million available for applications of $3 million or more in tax credits, subject to a competitive process and independent third-party review.

Below is a list of renewable projects as of May 10, 2010 that the Oregon Department of Energy has approved for a Business Energy Tax Credit Preliminary Certification (since July 1, 2009). This does not include renewable manufacturing facilities.
This list is based on information provided by the applicant. Projects will still need to go through the final application review process prior to being issued a tax credit. The list is subject to change based on the project's business plan, conditions not met, etc.
