New temporary rule for BETC projects now in effect

SALEM — The Oregon Department of Energy has implemented a temporary rule change to the Business Energy Tax Credit program. The temporary rule, which became effective on Jan. 13, 2012, prohibits project owners from amending their project costs and increasing the anticipated amount of tax credits. This temporary rule only applies to current projects with a BETC preliminary certification. Permanent rulemaking is expected to take place this summer.
This rule was implemented to support the intent of House Bill 3672 (2011), which required BETC applications to receive preliminary certification by July 1, 2011. These temporary rules apply to the old BETC program, which is being replaced by a new Energy Incentives Program created by the 2011 Legislature.
