The Oregon Department of Energy filed permanent rules today for the Small Scale Local Energy Loan Program, effective Sept. 30, 2014.

The permanent rules remove from rule the Oregon State Treasurer representative ex-officio position from the Small Scale Local Energy Project Advisory Committee. The Oregon State Treasurer may still designate a representative to attend and observe the Small Scale Local Energy Project Advisory Committee meetings as a member of the public.

The permanent rules for SELP formalizes the Small Scale Local Energy Project Advisory Committee (SELPAC) recruitment and appointment process, sets committee term limits and creates an ex-officio seat for an Oregon State Treasurer representative.

Public Hearing

The Oregon Department of Energy will hold a public hearing to receive comments on draft rules for the Small-scale Energy Loan Program. The proposed rule removes the Oregon State Treasurer representative ex-officio position from the Small-scale Local Energy Project Advisory Committee (SELPAC) appointment process. The Oregon State Treasurer may still designate a representative to attend, observe and participate in the SELPAC meetings as a member of the public.

The Oregon Department of Energy proposes draft rules for the Small Scale Local Energy Loan Program to formalize the Small Scale Local Energy Project Advisory Committee (SELPAC) recruitment and appointment process, set committee term limits and create an ex-officio seat for an Oregon State Treasurer representative. The draft rule proposes a formal recruitment announcement and process to seek potential members and reserves the right for the director to remove members upon missing a certain number of committee meetings or other causes. By statute, committee members may serve four-year terms. The rule proposes setting a two-term limit, allowing members to serve eight years in total. Lastly, the draft rule proposes creating an ex-officio seat on the committee occupied by a designated representative of the Oregon State Treasurer. The ex-officio member would be a non-voting member of the committee and may not be counted for establishing a quorum.

Permanent rules filed for the Alternative Fuel Vehicle Revolving Fund and SELP

The Oregon Department of Energy filed permanent rules establishing the Alternative Fuel Vehicle Revolving Fund program and revising the Small Scale Local Energy Loan Program. The new rules are effective Dec. 12, 2013.

The permanent rules implement the Alternative Fuel Vehicle Revolving Fund program, established during the 2013 legislative session. The program provides loans to Oregon’s public bodies and federally recognized tribes to assist in the purchase of new alternative fuel vehicles and help convert existing gasoline or diesel vehicles to alternative fuels. The department will publish a funding opportunity announcement in early January.

The rules also amend the definition of “fleet” for the Small Scale Local Energy Loan Program to require a minimum of two (rather than three) vehicles and adopt a temporary rule to clarify eligible uses of loan proceeds for Small Scale Local Energy Loan Program projects.

In early 2014, the department plans to begin rulemaking to provide a tax credit for the acquisition of alternative fuel vehicle fleets under the Energy Incentives Program (as provided for during the 2013 legislative session). The tax credit for fleets will be available starting Jan. 1, 2015.

Rulemaking Summary:

Senate Bill 583 (2013) establishes the Alternative Fuel Vehicle Revolving Fund to provide loans to Oregon’s public bodies and federally recognized tribes. These loans will assist in the purchase of new alternative fuel vehicles and help convert existing gasoline or diesel vehicles to alternative fuels. The Oregon Department of Energy will administer the fund and related loans through its Small Scale Energy Loan Program.

The Oregon Department of Energy invites stakeholders to participate in the rulemaking process. At the meeting, the department will review draft rules and discuss the process and other aspects related to the Alternative Fuel Vehicle Revolving Fund. The rulemaking will also include adopting a temporary rule filed on June 17, 2013.

The temporary rule for the Small Scale Energy Loan program (SELP) clarifies eligible uses of loan proceeds. In December 2012, the Oregon Department of Energy (ODOE) filed permanent rules amending OAR 330-110-0040(9) incorrectly.

Temporary Rule Justification: As currently written, without a temporary rule, a borrower could attempt to obtain a SELP loan for a single item, rather than a group of items that makeup a SELP project. This creates confusion about the allowable uses of bond funds as regulated by federal law. By adopting this temporary rule, ODOE will be able mitigate confusion and align with federal law.

Permanent Rules: ODOE plans to begin the process of permanent rulemaking by filing notice with the Secretary of State by July 15, 2013. A rulemaking hearing could be held in late August with permanent rules filed in early September 2013. Since a rulemaking advisory committee has previously reviewed and provided substantive input for this rule change, ODOE does not need a rulemaking advisory committee to initiate permanent rulemaking for the temporary rule.
