New Access Management Laws - SB264
Introduction


 
Enrolled Senate Bill 264 was signed by the governor on June 14, 2011. The bill reflects the work of a collaborative stakeholder committee in response to legislative direction to "codify, clarify, and bring consistency to issuance of access permits based on objective standards." Most of the provisions of the bill that affect the ODOT’s access permit policies, rules, and procedures go into effect on January 1, 2012 in the form of Temporary Rules.
 
 
 
 
 

Background
 
Enrolled Senate Bill 1024 (2010) directed ODOT, in cooperation with stakeholders, to develop proposed legislation to codify, clarify and bring consistency to issuance of access based on objective standards and to establish less stringent access management rules, measures and spacing and mobility standards for highway segments where the annual amount of daily traffic is 5,000 vehicles or fewer.
 
ODOT convened the Access Management (AM) Committee to carry out the legislature’s direction. The AM Committee’s 25 participants included members of the legislature, staff of local governments and private engineering firms, developers, representatives of the Oregon Trucking, the Retail Task Force and International Council of Shopping Centers, and the Oregon Home Builders Association. The AM Committee delivered its report to the legislature in January 2011 and worked with the legislature on development of SB 264.
 

Temporary Rules

Amended temporary rules took effect May 3, 2012 and will remain in effect until new permanent rules are approved by the Oregon Transportation Commission.

ODOT has begun the process to implement SB264, merging policy with technical requirements by drafting new administrative rules. ODOT has requested the assistance of the AMSC in converting the work that culminated into SB264 to this revised set of Administrative Rules. The AMSC meeting is scheduled for October 2011.

Next Steps
 
The OTC has approved the Temporary Rules for implementation on January 1, 2012.  The Department must adopt permanent rules by July 1, 2012.  ODOT and the AMSC have begun drafting the permanent rules to be submitted to the OTC for review and approval in the June 2012 OTC meeting.
 
Provisions of SB 264 applicable to ODOT become effective on January 1, 2012 and require extensive revisions to current administrative rules governing highway access.  The Department has developed an implementation strategy involving staff from traffic, maintenance, development review, project development, planning, technical services and other areas of the organization to work on the deliverables needed to meet the January 1, 2012 date.  The timeline for the implementation is aggressive with a target date of December 2011 for the Commission’s adoption of temporary rules.  The Department must adopt permanent rules by June 30, 2012.
