Rulemaking

Administrative rulemaking is the process by which administrative agencies create, amend, or repeal regulations. Rulemaking is a specific authority that the Oregon Legislature grants to an agency. When an agency is granted this authority, it can make administrative rules that have the full power of law. The Board of Parole is authorized to create rules under ORS 144.

Public comments will also be published on this page during the rulemaking process.

Amend 255-005-0005​

Amendment is needed to ensure that the public has a clear understanding of how the Board defines the terms "Parole Officer”, “Inoperative Time," “Abscond,” and “Supervising Officer”. Additional edits are made for clarity.​

RULE TITLE: Procedure for Administrative Review​​


Individuals affected by a Board action can object by filing for administrative review. The objection period lasts for 45 days from the mailing date of the Final Board Action. This amendment clarifies how the Board counts the days from mailing which starts the tolling of the period within which an objection can be filed.

Amendment is needed to ensure that the public has a clear understanding of how the Board calculates number of days that an individual has to obtain administrative review of a final Board action under existing law.​

Individuals on the Oregon sex offender registry who are classified under this division can object to their classification level under certain circumstances. The objection period lasts for 60 days from the date the individual was notified of their classification. This amendment clarifies how the Board determines the notification date which starts the tolling of the objection period.

Recent Rulemaking


Order


​​​Board revised its policies for adults in custody to apply for early medical release from incarceration in order to make the procedures more transparent and easier to understand. The new rules include a form for making a request and a form for the Department of Corrections to state the medical needs of the adult in custody.

​Change to attachment, Exhibit J, of SC4, SC5, SC6, & SC11. These amendments will bring these special conditions in line with the language of the corresponding condition language in the supervision conditions under Sex Offender Package A. In addition, these changes are designed to enhance protection for victims by clarifying that attempted contact with a victim constitutes a violation. No changes to rule itself, only to attachment. 

​CHAPTER 255 BOARD OF PAROLE AND POST-PRISON SUPERVISION


Amend 


Amending sex offender assessment methodology to include targeted assessments.

- The Board provided the 2025 legislature with a plan to complete the risk assessment and classification of registered sex offenders with convictions requiring them to register prior to 2014 (historic registrants). This amendment provides a research-informed targeted assessment methodology to complete the classification of historic registrants in 5 years.

​Modernize language, set maximum time for testimony with allowed additional time.

​Create formal process for requesting continuance or cancellation of Board hearings. 



RULE SUMMARY: Adopting this rule will allow the Board to request that the Department of Corrections provide correctional rehabilitation services to adults in custody when the Board defers their release.​
