Foster Care

 

ICPC was adopted into law by the 1975 Oregon legislature. The legislation mandates that placement must be approved and monitored through ICPC when a child in state custody is placed with a resource in another state, or a when a parent is placing a child in a non-relative setting. 
 

Oregon ICPC legislation can be found in Oregon Revised Statutes (ORS) 417.200. ICPC procedures are covered in DHS policy (OAR 413-040-0200-0330).

Legal Requirements​

The law requires compliance with laws of both Oregon and the state receiving the Oregon child. Certain responsibilities, such as resolving problems regarding ICPC placement issues and monitoring placement status, are assigned to Oregon and the state receiving the Oregon child. Approval to place a child across state lines must be received through ICPC before the child is placed outside of Oregon. If a violation of the ICPC law occurs, the violator is subject to penalty in either state in accordance with its laws.

Placements Covered by ICPC

ICPC is required when: 

1. A child is temporarily in the custody of the State of Oregon.
2. A parent is placing a child in a non-relative setting (i.e., residential treatment facility, group home, adoptive home).
3. A public agency is placing a child in an adoptive home.
4. A private agency is placing a child in an adoptive home. For information on private adoptions in Oregon, see the non-departmental adoptions page.
   

Placements Excluded from ICPC

ICPC is not required when: 

1. A child is placed in a boarding school or medical facility.
2. A child is being placed by a relative with another relative and the child is not in the temporary custody of the State of Oregon.
3. A child is visiting for no more than 30 days or the duration of a school break.
