2024 Notice of Permanent Rule Amendment

LUBA is proposing to amend its administrative rules. The proposed amendments codify LUBA's 2023 temporary rule amendment concerning the circumstances in which LUBA will conduct oral argument in person rather than remotely by video conference. Comments may be submitted via email at LUBA.Support@luba.oregon.gov. Please include “Comments on Proposed Rulemaking" in the subject line. Comments may also be submitted via the United States Postal Service at Land Use Board of Appeals, 775 Summer Street NE, Suite 330, Salem, Oregon 97301-1283. Comments will be accepted until 5:00 p.m. on February 23, 2024.

2023 Permanent Rule Amendments

Effective January 1, 2024, LUBA has amended its administrative rules. The amendments codify certain temporary rule amendments and are responsive to House Bills 3395 (2023) and 3458 (2023). 2023 Temporary Rule Amendments

Effective October 11, 2023, LUBA is temporarily amending some of its administrative rules. These amendments apply to proceedings commenced both before and after October 11, 2023. The proposed amendments are necessary to clarify the circumstances in which LUBA will conduct oral argument in person rather than remotely by video conference. Oral Argument

Remote oral arguments will be conducted by Zoom video conferencing.

Barring technical difficulties, LUBA will webcast remote oral arguments conducted by video conference and will provide access to archived versions of those arguments on YouTube. In-person oral arguments will be audio recorded and will not be video recorded or webcast.

Interested parties may request copies of digital video or audio recordings of oral arguments by contacting LUBA Support.

Note: OAR 661-010-0040(3) provides that "[a] party shall seek the consent of other parties before requesting a change in the scheduled time or date for oral argument. If you need to request a change to the date or time scheduled for oral argument, please contact LUBA by phone or email to inquire about available dates and times in advance of requesting a change. LUBA has a busy docket and cannot guarantee that your preferred date and/or time can be accommodated, but staff will provide you with available dates and times.
