This bulletin provides guidance on applying OAR 734-051-3020, Change of Use of a Private Connection. It is intended to help ODOT increase understanding of the factors involved in evaluating change of use of a private connection; and achieve greater statewide consistency in applying the rules.

The guidance is contained in two attachments to the bulletin. Attachment A - Evaluating Change of Use for a Private Connection, describes the evaluation process in OAR 734-051-3020. Attachment B - Prior Use Determination, describes how to determine the prior use of a property when evaluating change of use of an existing connection.

Definitions are contained in Attachment A.

New definitions, thresholds, and approval criteria for change of use were added to ORS 374 by the 2010 legislative assembly (Senate Bill 1024). Additional statutory changes were added in 2011 with the passage of Senate Bill 264. In 2013, Senate Bill 408 made additional changes. All of the statutory changes have been codified in OAR 734-051, effective June 30, 2014.
