Contracting with OPRD

Small Procurement for Goods, Services, A&E and Related Services, and Construction

Small Procurements for Goods, Services, A&E and Related Services, and Construction project thresholds are $1 to $100,000. These projects will be quoted and awarded in any manner OPRD deems practical or convenient, including by direct selection or award per OAR 736-146-0012(3).​

Intermediate Procurement for Goods, Services, A&E and Related Services, and Construction
Intermediate Procurements for Goods, Services, A&E and Related Services, and Construction project thresholds are $100,000 to $500,000. These procurements are required to seek at least three informally solicited competitive price quotes or competitive proposals from prospective contractors per OAR 736-146-0012(6).​


Formal Procurement for Goods, Services, A&E and Related Services, and Construction

Formal Procurements for Goods, Services, A&E and Related Services, and Construction project thresholds that exceed $500,000. These projects must be awarded by using a formal Request for Proposal (RFP) process if contractor selection will be based on criteria in addition to cost or if the ability to negotiate terms and conditions with the selected contractor is desired. The solicitation process must provide opportunities for prospective proposers to protest the solicitation and the award per OAR 736-146-0012(5). Information Technology Procurements

​Information Technology Procurements will be solicited as needed. All procurements will follow existing review thresholds for Department of Administrative Services Enterprise Information Services and Cybersecurity Services ​as required.

Price Agreements

​OPRD is no longer required to use mandatory use price agreements. OPRD will use price agreements that are advantageous to the agency based on need, cost, and terms and conditions. 

Sole Source Procurements

S​ole Source Procurements are procurements  for goods or services without competition that exceed a contract price of $100,000 if OPRD determines in writing that the goods or services are available from only one source. OPRD must base sole source determination on written findings that may include:

(A) That the efficient utilization of existing goods requires acquiring compatible goods or services;
(B) that the goods or services required to exchange software or data with other public or private agencies are available from only one source;
(C) that the goods or services are for use in a pilot or an experimental project; or
(D) other findings that support the conclusion that the goods or services are available from only one source. 

​OPRD must, to the extent reasonably practical, negotiate with the sole source provider to obtain contract terms that are advantageous to OPRD.
