Item A: Draft meeting minutes (Action)
Commissioners will review and take action on proposed draft minutes from the May 2023 meeting.

DEQ will present verbal and written updates on agency activities and other issues of interest to the commission.

DEQ’s Legislative Affairs Team will brief the commission on outcomes of the 2023 Legislative Session. Updates will include a summary of DEQ’s 2023-25 Legislative Approved Budget and other policy measures adopted by the legislature impacting the agency’s work.

In 2019, the Oregon Legislature passed HB 2007, now codified as ORS 468A.813, directing the Environmental Quality Commission to adopt a program, by rule, that will allow for owners and operators of diesel-powered construction equipment to demonstrate the emissions profile of each piece of equipment, and in turn receive emission control labels from DEQ that will reflect those profiles. The labels issued by DEQ would be placed on the outside of equipment or vehicles, which would make it easier for interested parties to identify key characteristics of the engines inside of them.

DEQ will present a proposal for a temporary rulemaking to implement a Title V Fee increase subject to approval from the legislature during the 2023 session.

DEQ’s Materials Management Program will present draft rules for implementation of the Mattress Stewardship Act, SB 1576 (2022). The proposed rules establish an annual fee, delegate authority to DEQ and clarify requirements of a stewardship organization.

DEQ will present and propose rule revisions for Waste Tires. The proposal would relocate these rules from Division 64, a stand-alone division specific to waste tires, into Divisions 93, 96 and 97, relevant divisions that pertain to other types of solid waste management. The proposal would also update fee types and align the requirements with Oregon Fire Code. The last update to the Waste Tire rules was in 1992.

The Oregon Water Resources Department is leading an inter-agency project team, which includes DEQ, to update the 2017 Statewide Integrated Water Resources Strategy. Staff from WRD and DEQ will provide an update on the project and seek input from the commission on key issues.

The temperature TMDLs for the Lower Columbia-Sandy Subbasin and Willamette Subbasins are the first two TMDLs of the court ordered schedule. This update is in preparation and prior to proposed rule adoption by the EQC in November 2023.
