Item A: Draft Meeting Minutes (Action)
Commissioners will review and take action on proposed draft minutes from the November 2023 regular meeting and the December 2023 special meeting.

Item B: Director's Report (Informational)
Agency staff will present written and verbal updates on DEQ activities and other issues of interest to the commission.

Item C: Commission Liaison Assignments (Informational)
Commissioners will discuss the assignment of the Oregon Watershed Enhancement Board liaison, a position that became vacant when former commissioner Molly Kile's term ended in September 2023. The EQC liaison is a voting member of OWEB and will participate in grant application approval and agency vision development. The commission will also reaffirm its liaison positions for the Board of Agriculture, currently held by Vice-Chair Sam Baraso, and the Board of Forestry, currently held by Commissioner Amy Schlusser.

Item D: Gasoline Dispensing Facility Emissions Rulemaking Update (Informational)
Agency staff will update the commission on DEQ's rulemaking to revise air quality applicable to Gasoline Dispensing Facilities (GDFs) found in Oregon Administrative Rules, Chapter 340, Divisions 242 and 244. The proposed rules are intended to reduce emissions from new and certain existing facilities. The agency expects to bring proposed rules to the commission at their meeting in March 2024.

Item E: Director Delegation Package and Rulemaking Plan (Action)
Agency staff will present their annual rulemaking plan and propose a package of specific one-time rulemakings to be delegated to the Director for final approval in calendar year 2024.

Item F: Climate Protection Program CCI Price Extension Temporary Rule (Action)
Agency staff will present a proposed temporary rule to allow DEQ to extend the current Community Climate Investment (CCI) contribution price of $123 from Feb. 29, 2024 to June 3, 2024. Fuel suppliers may comply in part with the Climate Protection Program by earning and using CCI credits. Fuel suppliers can earn CCI credits by contributing funds to a DEQ-approved CCI entity that implements projects that reduce human-caused greenhouse gas emissions in Oregon.

Working Lunch and Executive Session
The commission will hold a working lunch and executive session, pursuant to ORS 192.660(2)(a), (f) and (h). Executive session is a closed meeting for commissioners, specific DEQ staff and staff from the Oregon Department of Justice, to discuss confidential legal information and updates. Per state law, members of the media may attend executive session; however, they may not report on the specifics or details of any discussions or information presented during executive session. Item G: Public Forum
The commission will hold a comment opportunity for any environmental and public health issues relevant to DEQ and EQC. Sign-ups to comment will occur shortly before the start of this agenda item, and people are asked to limit comments to three minutes or less. Comment times may be reduced at the discretion of the commission if needed. The commission cannot accept comment on the following proposed rules: Gasoline Dispensing Facility Emissions, High Hazard Rail Tank Fee, Title V Fee Increase, and Powder Basin Total Maximum Daily Load.

Item H: Cleaner Air Oregon Five-Year Report (Informational)
Agency staff will update the commission on the implementation of the Cleaner Air Oregon program, including how the program is reducing air toxics emissions and associated health risks since rule adoption in November 2018. The report provides the status of permitted facilities in the program, highlights of the successes and challenges the program has faced over the past five years of implementation, and strategies and resources DEQ will utilize moving forward to increase the efficiency and effectiveness of the program.
