Bond Amount Increase FAQ

The  bond requirement for entities licensed with CCB will increase on January 1, 2024. Here's what you need to know.


Why are the minimum bond amounts increasing?

The bond amounts were increased by the 2023 Oregon Legislature – House Bill 2922 (link to bill: HB2922 (oregonlegislature.gov)

How much is the minimum bond amount increasing?

The bond amount will increase by $5,000 for each CCB endorsement type. A table at the bottom of this FAQ shows the new bond requirement for each endorsement.

How do I comply with the bond increase?

Many contractors will not need to take any action to comply. CCB has reached out to the surety (bond) companies to alert them to this change. Many surety companies have indicated they plan to update the bond amount for their clients automatically and will likely alert contractors separately.

Some contractors will need to take action to increase their bond if their surety company does not update the bond amount automatically. Watch for communications from your surety company, and if you do not receive any information about this increase, contact your surety company directly.

When does this change take place?

The increase will go into effect on January 1, 2024.  

If my surety company isn't updating my bond automatically, how shall I get the new bond certificate to the CCB?

Contractors or surety companies may submit an individual increase rider to increase the bond amount of an existing bond on file with the CCB.  These can be submitted to the fax, email or agency address.

What will happen if the CCB does not receive evidence of my bond increase by the deadline?

CCB will reach out to contractors that are out of compliance after January 1, 2024. These contractors will be given a deadline and instructions for compliance.

I have a bond that is higher than the required minimum, and my bond is already in compliance. Will my bond need to be increased?

If your bond is already in compliance with the new amounts, your bond will not need to increase. You do not need to take any action.

Will this change affect my insurance premium or the minimum required for my insurance?

No. This does not affect your general liability insurance.

Why are the minimum bond amounts increasing?

House Bill 2922 increased all minimum bond amounts required for contractors and other individuals licensed by the Oregon CCB by $5,000. You can review the new law here: HB2922 (oregonlegislature.gov)

Si mi compañía de fianzas contractuales no actualiza mi fianza contractual de manera automática, ¿cómo debo obtener el nuevo certificado de fianzas contractuales para CCB?

Los contratistas o compañías de fianzas contractuales pueden presentar una cláusula adicional de aumento individual para aumentar el monto de la fianza contractual de una fianza existente en el archivo de CCB.  Estos se pueden enviar a través de fax, correo electrónico o a la dirección de la agencia.

¿Qué sucederá si CCB no recibe evidencia del aumento de mi fianza contractual antes de la fecha límite?

CCB se comunicará con los contratistas que no estén cumpliendo con los requisitos después del 1 de enero de 2024. A estos contratistas se les dará una fecha límite e instrucciones para cumplir con los requisitos.

Tengo una fianza contractual que es más alta que el mínimo requerido y mi fianza contractual ya está cumpliendo con los requisitos. ¿Será necesario aumentar mi fianza contractual?

Si su fianza contractual ya está cumpliendo con los requisitos de los nuevos montos, no tendrá que aumentar su fianza contractual. No es necesario que realice ninguna acción.

¿Afectará este cambio a la prima de mi seguro o al mínimo requerido para mi seguro?

No. Esto no afecta a su seguro de responsabilidad general.

What ​is E-Proof?

E-Proof is CCB’s computer program that enables insurance agents to instantly submit proof of insurance electronically for licensed contractors.  This system cannot be used for new applicants.

New user?​​

To create an account, insurance agents must complete the E-Proof Application for online insurance  entry access​​.  Once your account has been created, the CCB will send an email confirmation with an access link.

Contractors working on qualifying public works projects with a total project cost of more than $100,000 must file a $30,000 public works bond with the Construction Contractors Board (CCB). The bond must be filed before work starts.  ​

Filing Instructions​

Contractors working on qualifying public works projects with a total project cost of more than $100,000 must file a $30,000 public works bond with the Construction Contractors Board (CCB). The bond must be filed before work starts.  
  • Licensed CCB contractors: You must sign the bond supplied by your bonding agent. Once signed, submit the bond directly to the CCB by mail or in person. 
  • Contractors not required to be CCB licensed: You must sign the bond supplied by your bonding agent. Once signed, submit the bond along with the completed Non-Construction Company Filing Statutory Public Works Bond form​ to the CCB.

Bond Q&A​​

Q; What is this bond used for?
A: This bond will be used solely in the event of a prevailing wage claim filed with the Bureau of Labor and Industries (BOLI).  

Q: Will this bond replace my CCB license bond? 
A: No. This bond is separate and is required in addition to any other bond a contractor or subcontractor is required to obtain. 

Q: Are there exemptions from the requirement of having to file the public works bond? 
A: Yes. You may be exempt for any of the following:

A: Contact your insurance agent, current bonding company or look in the yellow pages for bonding companies. 

Q: If I'm not a CCB licensed contractor do I still need this bond? 
A: Yes. If you are planning to contract or subcontract for a public works project you are required to file the publics work bond with the CCB. You must also provide the information requested in the form Non-Construction Company Filing Statutory Public Works Bondwith CCB. 

Q: Can I fax or email any of the information? 
A: Yes. You may fax the bond and other requested documents to (503) 373-2155 or email them to ccb.info@ccb.oregon.gov​

Q: Where can I get the bond form? 
A: Your bonding company may download the bond​ form from the Bureau of Labor and Industries​ website. The bond form must be filled out, signed and sealed by the bonding company.

Required Bond​​

Independent contractors working on qualifying public works projects exceeding $100,000 must file a $30,000 public works bond with the Construction Contractors Board.

Public Contract Delin​​quent Pay Compla​int form

Persons wishing to report that a contractor or subcontractor is delinquent in paying for labor or materials on a public works project shall do so on a Public Contract Delinquent Pay Complaint form​. This is only applicable to public works projects. 

CCB will determine if the contractor or subcontractor is “not qualified” to hold or participate in a public contracting for a public improvement. 

If the CCB determines that the claim  was made in bad faith or was false, the person filing the bad faith or false claim shall be placed on the list of persons who are not  qualified to hold or participate in public contracting.​

Improper Substitution Complai​​​nt for​​m​

Persons wishing to report that a contractor has substituted a first-tier subcontractor on a public works project for reasons not in conformance with ORS 279.585 shall do so on an Improper Substitution Complaint form​​. This is only applicable to public works projects. ​

For Public Agencies​​​​

Responsible Bidder Determination Form

All public entities that award public improvement contracts must complete a Responsible Bidder Determination Form. (ORS 279C.​375.) 

Not qualified to hold public contracts

The Construction Contractors Board maintains a list of contractors and subcontractors that are not qualified to hold or participate in any public contract for a public improvement. This list may include any corporation, partnership or other business entity of which the contractor or subcontractor is an owner, shareholder or officer of the business or was an owner or officer of the business. 

The law requires the CCB to determine whether a contractor is qualified to hold or participate in a public contract for a public improvement when: 
  • Information is received from a public contracting agency or from any person who supplied labor or materials, and
  • Labor and materials was related to a public contract for a public improvement, and
  • The contractor has not made payment to persons who supplied labor or materials, and
  • The payment was not made within 60 days when the payment was received by the contractor, and
The payment was not subject of a good faith dispute as defined in ORS 279C.580.
