Tonnage Requirements

All Fertilizer products, Agricultural Amendment products, Agricultural Mineral products, and Lime products that are registered (custom mixes also need to report and pay unless already captured) with the Department of Agriculture’s Fertilizer Program are required to pay tonnage fees.

What are tonnage inspection fees?

Tonnage fees are set at $0.45 for each ton of Fertilizer, Agricultural Amendment, or Agricultural Mineral product distributed. 

Tonnage fees are set at $0.05 for each ton of gypsum or of an agricultural mineral with a principal ingredient of calcium sulfate (CaSO4 *2H2O or CaSO4) distributed. 

Tonnage fees are set at $0.05 for each ton of lime product distributed.

There is a minimum inspection fee of $15, so if tons of material sold are less than $15, the person shall pay $15.

What if I do not have any sales or distribution during a tonnage period?

If a registered company (registrant) does not distribute any fertilizer, agricultural amendment, agricultural mineral or lime product into or within this state during a reporting period, the registrant must still file a semiannual tonnage and pay the minimum inspection fees.

What is exempt from tonnage fees?

Any Fertilizer, Agricultural Amendment, Agricultural Mineral, or Lime product in commercial transit through Oregon that is not destined for use or final distribution in the state of Oregon.

When are tonnage fees due?

Tonnage must be reported and fees paid twice per year. 

The reporting periods for each year: 

  • January 1 through June 30 
  • July 1 through December 31. 

Semiannual tonnage reports and inspection fees imposed under ORS 633.465 are due within 30 days after the end of the reporting period. 

If a registrant fails to file a semiannual tonnage report or pay an inspection fee on or before the due date the Department may assess a collection fee of 10 percent of the amount due or $25, whichever is greater. 

If the required tonnage report and associated fees are not reported and paid, the Department may take compliance action and also may suspend or deny the registration of any product(s).

How do I pay tonnage fees?

The ODA Fertilizer Program strives to send renewal notices to each registrant before each reporting period, based on mailing information on file. Those forms can be used to pay tonnage fees. 

If those forms are not received, due to lost mail or out-of-date mailing information, it is still the registrant’s responsibility to report tonnage and pay the associated fees. Blank forms are available below.
