With the recent changes at the federal level, the OLCC has received a number of questions from alcohol licensees and liquor agents about whether they may sell and/or serve hemp-derived beverages.

Businesses offering hemp-derived beverages are responsible for ensuring the products they sell comply with all applicable laws and rules.

About Hemp

“Hemp" refers to cannabis plants with no more than 0.3% total delta-9-THC. Cannabis plants that exceed 0.3% total delta-9-THC are “marijuana." Hemp products generally fall into three categories:

• Grain – Products made from hemp seeds
• Fiber – Products made from hemp stalk
• Cannabinoid hemp – Products made from hemp flower or cannabinoids like CBD extracted from hemp

The Oregon Department of Agriculture is the primary agency responsible for regulation of hemp and hemp products in Oregon. ODA licenses hemp growers and handlers and is responsible for hemp product testing rules. For more information, visit https://oda.direct/hemp

Certain hemp-related activities are also subject to regulation by OLCC. OLCC regulates:

• Limits on THC and semisynthetic cannabinoids in cannabinoid hemp products sold to minors in Oregon
• Limits on THC and semisynthetic cannabinoids in cannabinoid hemp products sold to adults in Oregon
• Packaging, labeling, and testing requirements for hemp vape products sold in Oregon
• Cannabinoid hemp entering the OLCC-licensed adult use marijuana system
