Archaeological Permit Rule

The proposed rulemaking will update the archaeology permit rule. The permit rule previously underwent major updates that were implemented on July 01, 2023. Since that time OPRD staff have been monitoring the effectiveness of the new rule. Following a major permit dispute that occurred in 2024, staff determined that the rule requires revisions to the dispute resolution procedures to better define the steps for informal negotiations, mediation, and arbitration in the event of a permit dispute. Other minor modifications are proposed to definitions, permit application revision procedures, and Oregon Qualified Archaeologist requirements.
